ValoMate 利用規約

第1条（はじめに）

本利用規約（以下「本規約」）は、個人開発者（以下「運営者」）が提供するモバイルアプリケーション「ValoMate」（以下「本アプリ」）およびウェブサイト https://valomate.web.app（以下「本ウェブサイト」。本アプリと総称して「本サービス」）の利用に関する条件を定めるものです。

利用者は、本サービスをダウンロード、インストール、アクセス、または使用することにより、本規約に同意したものとみなされます。本規約に同意いただけない場合は、本サービスの利用をお控えください。

第2条（定義）

本規約において使用する用語の定義は以下のとおりです。

  1. 「本アプリ」: 運営者が提供するモバイルアプリケーション「ValoMate」
  2. 「本ウェブサイト」: 運営者が https://valomate.web.app で提供するウェブサービス
  3. 「本サービス」: 本アプリおよび本ウェブサイトの総称
  4. 「利用者」: 本サービスを利用するすべての個人
  5. 「コンテンツ」: 本サービス内で提供されるテキスト、画像、動画、データ等の情報全般
  6. 「投稿コンテンツ」: 利用者が本サービスに投稿したテキスト、画像、座標等の情報
  7. 「外部サービス」: 本サービスが連携する第三者のサービス（YouTube、VLR.gg 等）

第3条（サービスの内容）

  1. 本サービスは、ゲーム「VALORANT」に関する以下の機能を提供する非公式のコンパニオンサービスです。
    • ラインナップ（戦術）情報の検索・閲覧
    • マップ、エージェント、アビリティに基づくフィルタリング
    • eスポーツの試合情報・結果の閲覧
    • プロチーム・選手情報の閲覧
    • お気に入りラインナップのブックマーク保存
    • ラインナップ情報の投稿（本ウェブサイトのみ・要アカウント登録）
  2. 本サービスは Riot Games が公式に提供するサービスではありません。 Riot Games 社およびその関連会社は、本サービスの内容について一切の責任を負いません。
  3. 本サービスで提供される情報の正確性、完全性、最新性について、運営者は最善の努力を行いますが、これを保証するものではありません。

第4条（利用条件）

  1. 本サービスは無料で提供されます。運営費用は広告収入により賄われています。
  2. 閲覧・検索等の基本機能の利用にアカウント登録は不要です。ラインナップ投稿等の一部機能の利用には、無料のアカウント登録が必要です。
  3. 本サービスの利用には、インターネット接続環境および対応する端末が必要です。
  4. インターネット接続に伴う通信料は利用者の負担となります。
  5. 本サービスは日本語・英語をはじめとする複数の言語に対応しています。

第5条（アカウント）

  1. 利用者は、アカウント登録にあたり、正確な情報を提供するものとします。
  2. 利用者は、自己の責任においてパスワードを管理するものとし、第三者への貸与・譲渡をしてはなりません。
  3. 運営者は、利用者が本規約に違反した場合、事前通知なくアカウントの利用を停止または削除できるものとします。
  4. 利用者は、第14条の連絡先に依頼することで、いつでもアカウントを削除できます。

第6条（投稿コンテンツ）

  1. 投稿コンテンツの著作権は、投稿した利用者に留保されます。ただし、利用者は運営者に対し、本サービスの提供・改善・宣伝に必要な範囲で、投稿コンテンツを無償で使用（複製、翻訳、公開等を含む）する権利を許諾するものとします。
  2. 利用者は、第三者の権利を侵害する情報を投稿してはなりません。
  3. 投稿コンテンツは、運営者による確認の後に公開されます。運営者は、本規約に違反する、または不適切と判断した投稿コンテンツを、事前通知なく非公開化または削除できるものとします。

第7条（禁止事項）

利用者は、本サービスの利用にあたり、以下の行為を行ってはなりません。

  1. 法令または公序良俗に違反する行為
  2. 本サービスのリバースエンジニアリング、逆コンパイル、逆アセンブル、またはソースコードの解析
  3. 本サービスのサーバーまたはネットワークへの不正アクセス
  4. 本サービスのコンテンツの無断での複製、転載、配布、または商用利用
  5. 本サービスまたは外部サービスに対する自動化されたアクセス（スクレイピング、ボット等）
  6. 広告の不正なクリック、表示回数の不正な操作等、広告配信を妨害または不正に操作する行為
  7. 本サービスの運営を妨害する行為
  8. 他の利用者または第三者の権利を侵害する行為
  9. その他、運営者が不適切と合理的に判断する行為

第8条（知的財産権）

  1. 本サービスの構造、デザイン、およびオリジナルコンテンツに関する知的財産権は、運営者に帰属します。
  2. VALORANT に関する帰属表示
    • 本サービスは、Riot Games, Inc. のポリシーに基づき、Riot Games が所有する資産を使用して作成されています。
    • Riot Games は本プロジェクトを支持または後援していません。
    • VALORANT およびその関連のロゴ、キャラクター名、画像等は Riot Games, Inc. の登録商標または商標です。
  3. 本サービス内で使用される第三者のコンテンツ（YouTube 動画、eスポーツデータ等）の権利は、それぞれの権利者に帰属します。

第9条（広告の掲載）

  1. 本サービスには、運営者または第三者配信事業者（Google AdMob、Google AdSense 等）による広告が表示されることがあります。
  2. 広告の配信に伴う Cookie 等の取り扱いについては、プライバシーポリシーをご確認ください。
  3. 広告を経由した利用者と広告主との取引等については、利用者と広告主の責任において行われるものとし、運営者は責任を負いません。

第10条（免責事項）

  1. 運営者は、本サービスの利用に関連して利用者に生じた損害について、運営者の故意または重大な過失による場合を除き、責任を負いません。
  2. 運営者の軽過失により利用者に損害が生じた場合、運営者の賠償責任は、直接かつ通常の損害に限定されます。
  3. 以下の事由により利用者に生じた損害について、運営者は責任を負いません（ただし、運営者の故意または重大な過失に起因する場合を除きます）。
    • 本サービスで提供される情報の正確性、完全性、有用性に関する事項
    • 外部サービス（YouTube、VLR.gg 等）の障害、仕様変更、またはサービス終了
    • 利用者の端末環境に起因する不具合
    • 天災、通信障害その他の不可抗力
    • 第三者による不正アクセスまたはサイバー攻撃
  4. 本サービスから外部サイトへのリンクが含まれる場合、当該外部サイトの内容について運営者は責任を負いません。

第11条（サービスの変更・中断・終了）

  1. 運営者は、以下の場合に、利用者への事前通知なく、本サービスの全部または一部を変更、中断、または終了できるものとします。
    • システムの保守、点検、更新を行う場合
    • 天災、停電、通信障害等の不可抗力が発生した場合
    • その他、運営者がやむを得ないと判断した場合
  2. 本サービスの終了にあたっては、運営者は合理的な期間をもって事前に通知するよう努めます。
  3. 本条に基づく変更、中断、または終了により利用者に生じた損害について、第10条の規定が適用されます。

第12条（利用規約の変更）

  1. 運営者は、必要に応じて本規約を変更できるものとします。
  2. 本規約を変更する場合、運営者は変更内容および施行日を、本サービス内または運営者が適切と判断する方法により通知します。
  3. 変更後の規約の施行日以降に利用者が本サービスを利用した場合、変更後の規約に同意したものとみなされます。

第13条（準拠法・管轄裁判所）

  1. 本規約の解釈および適用は、日本法に準拠するものとします。
  2. 本規約に関する一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

ValoMate Terms of Service

Article 1 (Introduction)

These Terms of Service ("Terms") set forth the conditions for the use of the mobile application "ValoMate" ("App") and the website https://valomate.web.app ("Website"; together with the App, the "Service") provided by an individual developer ("Operator").

By downloading, installing, accessing, or using the Service, users are deemed to have agreed to these Terms. If you do not agree to these Terms, please refrain from using the Service.

Article 2 (Definitions)

The terms used in these Terms are defined as follows:

  1. "App": The mobile application "ValoMate" provided by the Operator
  2. "Website": The web service provided by the Operator at https://valomate.web.app
  3. "Service": The App and the Website collectively
  4. "User": Any individual who uses the Service
  5. "Content": All information provided in the Service, including text, images, videos, and data
  6. "User Content": Text, images, coordinates, and other information submitted to the Service by users
  7. "External Services": Third-party services integrated with the Service (YouTube, VLR.gg, etc.)

Article 3 (Service Description)

  1. The Service is an unofficial companion service that provides the following features related to the game "VALORANT":
    • Searching and viewing lineup (tactical) information
    • Filtering by map, agent, and ability
    • Viewing esports match information and results
    • Viewing professional team and player information
    • Bookmarking favorite lineups
    • Submitting lineup information (Website only; account required)
  2. The Service is not an official service provided by Riot Games. Riot Games and its affiliates bear no responsibility for the content of the Service.
  3. While the Operator makes best efforts regarding the accuracy, completeness, and timeliness of information provided in the Service, these are not guaranteed.

Article 4 (Conditions of Use)

  1. The Service is provided free of charge. Its operation is funded by advertising revenue.
  2. No account registration is required for core features such as browsing and search. Certain features such as lineup submission require free account registration.
  3. An internet connection and a compatible device are required to use the Service.
  4. Data charges associated with internet connectivity are borne by the user.
  5. The Service supports multiple languages, including Japanese and English.

Article 5 (Accounts)

  1. Users shall provide accurate information when registering an account.
  2. Users shall manage their passwords at their own responsibility and shall not lend or transfer them to third parties.
  3. If a user violates these Terms, the Operator may suspend or delete the user's account without prior notice.
  4. Users may delete their account at any time by contacting us as described in Article 14.

Article 6 (User Content)

  1. Copyright in User Content remains with the user who submitted it. However, the user grants the Operator a free-of-charge license to use (including reproduce, translate, and publish) the User Content to the extent necessary for providing, improving, and promoting the Service.
  2. Users must not submit information that infringes the rights of third parties.
  3. User Content is published after review by the Operator. The Operator may unpublish or delete User Content that violates these Terms or is otherwise deemed inappropriate, without prior notice.

Article 7 (Prohibited Actions)

Users must not engage in the following actions when using the Service:

  1. Actions that violate laws or public order and morals
  2. Reverse engineering, decompiling, disassembling, or analyzing the source code of the Service
  3. Unauthorized access to the Service's servers or networks
  4. Unauthorized reproduction, redistribution, distribution, or commercial use of the Service's content
  5. Automated access to the Service or External Services (scraping, bots, etc.)
  6. Fraudulent ad clicks, impression manipulation, or any other actions that interfere with or manipulate ad delivery
  7. Actions that interfere with the operation of the Service
  8. Actions that infringe on the rights of other users or third parties
  9. Other actions that the Operator reasonably deems inappropriate

Article 8 (Intellectual Property Rights)

  1. Intellectual property rights related to the structure, design, and original content of the Service belong to the Operator.
  2. VALORANT Attribution
    • The Service was created using assets owned by Riot Games, based on the policies of Riot Games, Inc.
    • Riot Games does not endorse or sponsor this project.
    • VALORANT and its related logos, character names, and images are registered trademarks or trademarks of Riot Games, Inc.
  3. Rights to third-party content used in the Service (YouTube videos, esports data, etc.) belong to their respective rights holders.

Article 9 (Advertising)

  1. The Service may display advertisements served by the Operator or third-party vendors (such as Google AdMob and Google AdSense).
  2. For information on the use of cookies and similar technologies in connection with ad delivery, please see the Privacy Policy.
  3. Any transactions between users and advertisers made through advertisements are the responsibility of the user and the advertiser, and the Operator bears no responsibility for them.

Article 10 (Disclaimer)

  1. The Operator shall not be liable for damages incurred by users in connection with the use of the Service, except in cases of intentional misconduct or gross negligence by the Operator.
  2. If damages are incurred by users due to minor negligence of the Operator, the Operator's liability shall be limited to direct and ordinary damages.
  3. The Operator shall not be liable for damages incurred by users due to the following reasons (except where caused by the Operator's intentional misconduct or gross negligence):
    • Matters related to the accuracy, completeness, or usefulness of information provided in the Service
    • Failures, specification changes, or discontinuation of External Services (YouTube, VLR.gg, etc.)
    • Malfunctions caused by the user's device environment
    • Natural disasters, communication failures, and other force majeure events
    • Unauthorized access or cyberattacks by third parties
  4. If the Service contains links to external websites, the Operator shall not be responsible for the content of those external websites.

Article 11 (Changes, Suspension, and Termination of Service)

  1. The Operator may change, suspend, or terminate all or part of the Service without prior notice to users in the following cases:
    • When performing system maintenance, inspection, or updates
    • When force majeure events such as natural disasters, power outages, or communication failures occur
    • Other cases where the Operator deems it unavoidable
  2. When terminating the Service, the Operator shall endeavor to provide advance notice within a reasonable period.
  3. The provisions of Article 10 shall apply to damages incurred by users due to changes, suspension, or termination under this Article.

Article 12 (Changes to Terms of Service)

  1. The Operator may change these Terms as necessary.
  2. When changing these Terms, the Operator shall notify users of the changes and effective date through the Service or by other means deemed appropriate.
  3. If users use the Service after the effective date of the revised Terms, they are deemed to have agreed to the revised Terms.

Article 13 (Governing Law and Jurisdiction)

  1. The interpretation and application of these Terms shall be governed by the laws of Japan.
  2. The Tokyo District Court shall be the court of exclusive jurisdiction in the first instance for all disputes related to these Terms.
